Terms & Conditions

1. Acceptance & Digital Signature

• Creating a profile, submitting a registration form, or ticking the agreement checkbox on the Elite Traders Lounge website constitutes a binding digital signature and acceptance of these Terms & Conditions and the accompanying contract emailed to you.
• You must be at least 18 years old and legally capable of entering into a binding contract to register as a Babysitter or as a Family representative.
• If you register on behalf of a household, you confirm you are authorised to bind that household to these terms.

2. Eligibility & Identity Verification

• South African citizens and permanent residents register using a valid South African ID number.
• Foreign nationals may register as freelance Babysitters using a valid passport, provided they hold a valid work permit or other legal authorisation to perform paid work in South Africa under the Immigration Act 13 of 2002. Elite Traders Lounge does not place or pay any Babysitter who cannot demonstrate the legal right to work in South Africa, and reserves the right to request the physical work permit document at any time.
• All Families and Babysitters must complete identity verification through Smile ID (document authentication and facial liveness check) before a Babysitter is placed in, or a Family may book care at, a household. Bookings and placements are provisional until Smile ID verification is complete.
• Providing false, forged, or expired identity documents is grounds for immediate account suspension and may be reported to the relevant authorities.
• Every Babysitter must hold a valid SAPS Police Clearance Certificate, a Child Protection Register (Part B) clearance letter, and a National Register for Sex Offenders (NRSO) certificate confirming they are not listed as unsuitable to work with children, submitted at registration and reviewed by Elite Traders Lounge before verified status is granted.
• Foreign national Babysitters must additionally provide a police clearance certificate from any country they resided in for 12 or more months as an adult within the preceding 5 years, in line with the definition used under the Immigration Act 13 of 2002, each dated within 6 months of submission.
• Annual re-verification. To remain eligible for placement, every Babysitter — South African or foreign national — must renew their Police Clearance Certificate, Child Protection Register (Part B) clearance and NRSO certificate every 12 months from the date the current documents were accepted (Level 5 Babysitters renew the Police Clearance Certificate and Child Protection Register clearance every 6 months, as set out on the Policies page), submitted via the Babysitter's dashboard. Elite Traders Lounge may suspend or withdraw a Babysitter's verified status, and remove them from public search results, if renewal documents are not submitted by the due date.

3. Background, Document & Random Verification Checks

• In addition to the identity, police clearance, and Child Protection Register checks described in Section 2, Elite Traders Lounge may carry out discretionary or random verification checks on any Babysitter's or Au Pair's submitted documents, background, or information at any time, including after a candidate has already been verified.
• All Babysitters and Au Pairs must give general consent, at registration, for Elite Traders Lounge to carry out this kind of discretionary or random verification check. This consent is separate from, and in addition to, the specific consents described in Section 2 (Smile ID identity verification) and this section (CheckNet result-sharing).
• Candidates who choose to use CheckNet (Pty) Ltd, an independent South African verification provider, to obtain their police clearance, Child Protection Register, or NRSO documents may consent to CheckNet sending those results directly to Elite Traders Lounge at verifications@etlbabysitters.co.za. This direct-sharing consent is optional per document but does not replace the requirement to also upload the same documents to the Elite Traders Lounge platform — document upload remains mandatory regardless of whether direct sharing consent is given.
• Elite Traders Lounge does not require candidates to pay for or complete any single named, standalone third-party background-check product as a condition of registration. Candidates remain free to use any accredited South African provider (including CheckNet or a government office) to obtain the police clearance, Child Protection Register, and NRSO documents required under Section 2.
• Elite Traders Lounge may, at its discretion, use the information gathered under this section to suspend, decline, or remove a candidate's verified status, consistent with Section 14 (Right to Refuse or Cancel Service).

4. Proof of Address

• Both Babysitters and Families must provide proof of address — a utility bill, bank statement, lease agreement, or a sworn affidavit confirming residential address — dated within the last three (3) months.
• Proof of address is used to confirm the Babysitter's home address for safety and background checks, and the Family's address as the verified location where care will be provided.
• Elite Traders Lounge may request an updated proof of address at any time, including where an address on file appears out of date.

5. Reference & Affidavit

• Every Babysitter must supply at least one contactable reference (name, relationship, phone number, and email address) at the time of registration.
• The nominated reference will be asked to complete the standard Elite Traders Lounge Reference Affidavit (Appendix A of the Babysitter Contract), sworn before a Commissioner of Oaths, confirming their relationship to the Babysitter and their honest assessment of the Babysitter's character and childcare experience.
• Elite Traders Lounge may contact the reference directly by phone or email to verify the information supplied and confirm the affidavit's authenticity.
• A Babysitter profile is marked "Reference Verified" only once a completed, signed affidavit has been received and checked.

6. Local Service Area (20km Radius)

• Elite Traders Lounge can only confirm a booking where a verified, active Babysitter is located within a 20km travel radius of the Family's registered town or suburb ("local service area"). This is the distance within which we are willing to match a booking, taking into account the time and cost a Babysitter has to spend reaching it.
• Both Babysitters and Families must supply their town/suburb and province at registration or booking, so Elite Traders Lounge can calculate this distance. This is a mandatory condition of registration and booking, not an optional field.
• Families are encouraged to check whether a verified Babysitter currently covers their area — using the "Check if we cover your area" tool on the website or the sitter list shown when booking — before completing registration or a booking request.
• Where no verified Babysitter is within 20km of a Family's location, Elite Traders Lounge will decline the booking request and will contact the Family to discuss options, including the possibility of onboarding a Babysitter closer to them.
• The list of towns currently covered by a verified Babysitter is shown on the website and updates automatically as new Babysitters register and complete verification — it is not a fixed or guaranteed list, and coverage may change over time as Babysitters join, leave, or update their status.
• This policy exists to keep the travelling a booking requires within reasonable limits for the Babysitter; it does not limit a Babysitter's or Family's right to independently arrange care outside of the Elite Traders Lounge platform.
• Travel costs. No separate travel charge applies to a booking, and none is added to what a Family pays. The 20km limit above is how we keep travel costs and travelling time reasonable in the first place, rather than confirming a long journey and charging for it afterwards. A Babysitter is responsible for her own transport to and from a booking and should decline any booking she cannot reach affordably or safely; she is under no obligation to accept one, and declining on those grounds carries no penalty. Elite Traders Lounge does not pay Babysitters and does not reimburse transport. We reserve the right to introduce a published, distance-based travel fee in future, payable by the Family to the Babysitter and applied only going forward, never retroactively; we do not commit to doing so, and any such fee would appear on the Rates & Policies page before it applied to any booking.

7. Family Declaration & Undertaking: Sitter Safety, Dignity and Human Rights

By submitting a booking, the Family solemnly declares and undertakes the following. This is a binding representation forming part of the Family Service Agreement — not a sworn affidavit deposed before a Commissioner of Oaths — but Elite Traders Lounge treats a false declaration with the same seriousness as any other breach of this agreement, as set out below.

• The Family has disclosed, completely and accurately to the best of its knowledge, every adult who will be present at the service address during the Babysitter's engagement — including a spouse, partner, adult child, extended family member, tenant, or domestic employee — in the household disclosure field of the booking form.
• The Family undertakes that it, and every household member so disclosed, will treat the Babysitter at all times with the same dignity, respect, and regard for personal safety that the Family would want for a member of its own family in a comparable position — consistent with the rights to human dignity (section 10) and to freedom and security of the person (section 12) guaranteed to everyone under Chapter 2 (the Bill of Rights) of the Constitution of the Republic of South Africa, 1996.
• The Family undertakes that the Babysitter will not be subjected to unfair discrimination on any ground listed in section 9(3) of the Constitution, nor to harassment, abuse, threats, or degrading treatment unlawful under the Protection from Harassment Act 17 of 2011 or the Domestic Violence Act 116 of 1998, by any household member.
• Though engaged as an independent contractor and not the Family's employee, the Babysitter is entitled to a standard of on-site treatment no less protective than that set out for domestic workers under the Basic Conditions of Employment Act 75 of 1997 and Sectoral Determination 7 — including reasonable rest breaks, a safe environment, and freedom from unpaid duties beyond the booking's declared scope (see also the Code of Conduct on the Policies page).
• A Babysitter who feels unsafe or reasonably believes this declaration is being violated by any household member may end the booking and leave immediately — no justification is required in the moment, and doing so is never penalised, rated down, or grounds for suspension.
• Children must be present: no booking of a Babysitter to attend an adult alone. A Babysitter is engaged for one purpose only — the care and supervision of the children named in the booking. If the Babysitter arrives and the children are not present at the service address, and the only person present is an adult, the booking does not begin. The Babysitter is entitled to leave immediately, and remains entitled to the full Babysitter fee for the booking as though it had been completed. She is not required to wait, to accept an assurance that the children will arrive later, to enter the premises, or to give a reason for leaving. This applies regardless of the adult's gender or relationship to the children. A Family that books a Babysitter in circumstances where the children are not present, or that misrepresents the purpose of a booking, commits a material breach of this agreement.
• Ending a booking on this basis does not by itself decide who is paid. Within 48 hours, the Babysitter must submit a report through the Dispute Resolution process (category: Safety), giving as much detail as possible — what happened, who was involved, and any available evidence such as messages, photos, or witness details. While that report is open, no payment is released to either party for the booking, exactly as with any other open dispute.
• If Elite Traders Lounge's investigation substantiates the report, or the Family does not dispute it, the Family is required to pay the full booking cost, which is paid to the Babysitter in full as though the booking were completed; the Family's account may be suspended or terminated; and the matter may be reported to the relevant authorities where appropriate. If the investigation is inconclusive, or the report is contradicted by credible evidence, the standard Cancellation Policy applies instead, at Elite Traders Lounge's sole discretion.
• This process runs equally in the other direction: a Family that reports a genuine safety or conduct concern about a Babysitter triggers the same investigation and possible outcomes. Elite Traders Lounge reserves the right, per Section 14 (Right to Refuse or Cancel Service), to decide who it works with, and may suspend or decline either a Babysitter or a Family at its discretion.
• Elite Traders Lounge will treat a knowingly false declaration under this clause — for example, concealing a household member with a known history of violence toward caregivers — with the same severity as providing fraudulent information under Section 2 of these Terms, and may suspend the Family's account and report the matter to the Babysitter and relevant authorities where appropriate.
• The same standard applies to a Babysitter's report. The entitlement set out above exists so that a Babysitter never has to weigh her safety against her earnings, and Elite Traders Lounge will not discourage a report or treat one as suspicious merely because it was made. That protection depends on the report being honest. A Babysitter who knowingly submits a false or materially misleading report under this clause — including reporting that the children were not present when they were, or claiming a safety concern in order to end a booking she simply did not wish to perform — commits a material breach of the Babysitter Contract. Elite Traders Lounge treats this with the same severity as providing fraudulent information, and reserves the right to withhold the fee for that booking, to suspend or permanently remove the Babysitter from the platform, and to refuse her future bookings. A report that is simply not substantiated, or that turns out to rest on a genuine misunderstanding, is not a false report and carries no consequence of any kind.
• Consequences Elite Traders Lounge reserves the right to apply. Where a report of harassment, intimidation, sexual misconduct, inappropriate behaviour, or an unsafe environment is substantiated against a Family or a member of its household, Elite Traders Lounge reserves the right, at its sole discretion and without any obligation to do so in any particular case, to: suspend or permanently close the Family's account; refuse all future bookings from that Family, household, or service address indefinitely; retain a record of the matter for the purpose of enforcing that refusal; recover from the Family any amount it is required to pay a Babysitter as a result; and pursue a claim for damages or any other remedy available to it in law. Elite Traders Lounge does not undertake to take any of these steps, and its decision not to do so in one case creates no expectation in another.
• Records and disclosure to the South African Police Service. Elite Traders Lounge keeps records of each booking, including check-in and check-out confirmations with their timestamps and any location stamp recorded against them, the household disclosure made on the booking form, the declaration accepted at booking, and any report submitted through the Dispute Resolution process. Check-in and check-out timestamps are additionally anchored to a public distributed ledger as a hash, so the time an event was recorded can be independently verified and cannot be quietly altered afterwards. Elite Traders Lounge may disclose these records to the South African Police Service or another competent authority where it is required to do so by law, where it is compelled by lawful process, or where it reasonably believes disclosure is necessary to protect the life, safety, or physical integrity of any person. This is a reserved right and not an undertaking to disclose in any given case, and any disclosure is made in accordance with POPIA and the data protection section of our Policies.
• Nothing in this Section limits a Babysitter's or a Family member's own right to report a matter directly to the South African Police Service, and Elite Traders Lounge will not discourage any person from doing so.

8. Booking Hours: 18:00 Day Cut-Off, Absolute 22:00 Limit

This clause governs how late a booking may run, and who arranges and pays for the Babysitter's journey home. It applies to every Family booking and to Hotel & Airbnb Partner bookings.

• A Day Booking ends no later than 18:00. This includes the Full-Day flat rate. The finish time determines how the Babysitter travels home, and she funds her own transport, so the time she is released matters as much as the distance she must cover.
• Work that runs later is an Overnight Booking. Where care is needed past 18:00, the booking is made as an Overnight Booking, under which the Babysitter remains at the premises and does not travel home at night at all.
• Limited exception, and only up to 22:00. A booking may end after 18:00, but never later than 22:00, and only where both of the following apply:
  • the Babysitter is Level 3 or above; and
  • transport home is arranged as either (i) the Babysitter's own vehicle, where she has provided Elite Traders Lounge with the vehicle's registration number and we have verified it; or (ii) door-to-door e-hailing (Bolt, Uber or a comparable service) to her home address, arranged and paid for by the Family.
• Levels 1 and 2 are not available for a booking ending after 18:00. The exception is reserved for the higher tiers.
• A booking ending after 18:00 is charged for a minimum of five hours. This is a minimum charge, not a minimum length: the care window may be shorter than five hours, and the booking is billed at five hours regardless. A booking from 19:00 to 22:00 is three hours of care charged as five. The Babysitter is paid on the five billed hours, not on the hours worked, and Elite Traders Lounge's commission is unchanged at the rate published for her level in the Policies & Rates. The Family is shown the full amount in the quote before the booking is submitted and is free to accept it or not to book.
• The care window for a booking ending after 18:00 must be at least 2.5 hours. Because no booking may finish later than 22:00, the latest such a booking may start is 19:30.
• Hotel & Airbnb Partner bookings. The 18:00 cut-off, the 22:00 limit and the Level 3 requirement apply to Partner bookings in the same way. Neither the five-hour minimum charge nor the 2.5-hour care window applies: Partner bookings already carry their own minimum booking length under the Hotel & Airbnb Partner Policy and Payment Terms, which is longer than 2.5 hours, and that minimum continues to apply instead. For a Partner day booking that minimum is three hours, so the latest such a booking may start is 19:00. On a Partner booking finishing after 18:00 the Partner is the payer of the Babysitter's journey home, and must arrange and pay for door-to-door e-hailing to her home address. The Babysitter's own vehicle is not an available arrangement on a Partner booking, because Partner bookings are matched by Elite Traders Lounge after the request is submitted and no specific Babysitter, or verified vehicle, exists at that point.
• The Family bears the cost of transport home under (ii). It is not deducted from the Babysitter's fee and is not payable by her. Elite Traders Lounge does not pay for, reimburse, or arrange the Babysitter's transport, and takes no part of any amount the Family spends on it.
• The arrangement is recorded with the booking. The Family selects it at booking and it forms part of the Family Service Agreement for that booking. The platform will not accept a Day Booking ending after 18:00 without one.
• A Babysitter is entitled to decline. Nothing in this clause obliges any Babysitter to accept a booking ending after 18:00, whatever her level and whatever transport is offered. Declining carries no penalty and does not affect her standing on the platform.
• Insurance is not provided or verified. Where a Babysitter travels in her own vehicle, she does so at her own risk and in her own capacity. Elite Traders Lounge does not insure her, any passenger, or her vehicle; does not verify whether any vehicle is insured; and is not liable for any accident, loss, injury, damage, fine, or traffic penalty arising from her journey to or from a booking. Ensuring that her vehicle is roadworthy, licensed, and lawfully driven, and that she holds any insurance she wishes to have, is hers alone.
• Elite Traders Lounge may decline, cancel, or refuse to match any booking that does not comply with this clause.

9. Payments (Paystack)

• How the Family pays. All booking payments are processed securely through Paystack. The Family pays the full amount for a booking once, upfront.
• How the Babysitter is paid. The Babysitter receives her full rate. Nothing is taken off it. It is paid into the South African bank account she registered with Elite Traders Lounge. Her bank account must be in her own name, and she must keep the details up to date, because that is where payouts are sent. Neither Babysitters nor Families need their own Paystack account. Families pay by card like any other customer, and Babysitters are paid by bank transfer.
• When the Babysitter is paid. A payout is released only when all of these are true: the booking is complete, both the Family and the Babysitter have confirmed it on the platform, and a 7-day confirmation window has passed. No payout is released while a dispute or chargeback is open on that booking. See Dispute Resolution on the Policies page.
• Babysitters are independent contractors. Elite Traders Lounge does not employ them and does not pay them a wage, salary or retainer. It does not promise any Babysitter a minimum number of bookings or a minimum income.
• Platform fee. Elite Traders Lounge charges a fixed platform fee per hour, set for each level and booking type (see Appendix C). The Family pays it on top of the babysitter’s rate, and it is shown as its own line in the quote before you pay. Babysitters pay no platform fee: nothing is deducted from their rate. There is no other booking charge on top of the platform fee.
• Important: the platform fee is never refunded. The platform administration fee is Elite Traders Lounge’s fee. It is shown as its own line in the quote before you pay. Once a booking is confirmed, it is not refunded for any reason, even if you cancel 48 hours or more ahead. Refunds for cancellations (see the Refund & Cancellation Policy) cover only the Babysitter's booking fee, and are paid back through Paystack to the card you paid with.
• Yearly registration & verification fee. Every Family pays R499 once a year to cover identity and document checks. It is paid through the Paystack link on the booking form. It is separate from, and in addition to, the platform fee on bookings. It is not refunded once verification has started. It is due again 12 months after it was last confirmed paid, because Families’ identity details are re-checked every year. Babysitters pay no registration or verification fee.
• Overtime is paid through Paystack, never in cash. Once both sides confirm departure with the check-in tool, the system works out any time past the booked end time from those confirmed times. The same babysitter rate and platform fee per hour as the booking apply. The Family then receives a Paystack payment link for the exact amount. Families and Babysitters may not settle overtime, or any other charge for platform work, in cash or in any other way outside the platform. See Policies Sections 6.4–6.5.
• Hotel & Airbnb partner bookings. These are bookings that a verified hotel, guesthouse, or Airbnb or short-stay host makes for a guest. They use a separate partner rate, not the Family and Babysitter rates in Appendix C. The Babysitter always receives 65%. The other 35% is split between Elite Traders Lounge and the hotel or host, on tiers that grow with the number of referrals. Full details are in Appendix D of the Policies page and in the partner's signed Partner Agreement. The same rules apply as for every booking: payment upfront through Paystack with no exceptions, and the same dispute hold and payout process. Elite Traders Lounge does not advance or front money for these bookings, just as it does not for a direct Family booking.

10. Individual Contracts & Delivery

• On successful registration, Elite Traders Lounge issues each Babysitter the current Babysitter Agreement and each Family the current Family Service Agreement by email to the address supplied, and makes a downloadable copy available from the confirmation screen.
• These individual contracts set out the specific rate, platform fee, minimum-wage compliance, and cancellation terms that apply to that party, and incorporate these Terms & Conditions and the Rates & Policies page by reference.
• It is each party's responsibility to read the emailed contract and raise any queries with Elite Traders Lounge before accepting or confirming a booking.

11. Account Access Codes & Security

• Elite Traders Lounge does not use traditional usernames and passwords. A Family signs in with its booking reference and PIN; a Babysitter, Au Pair, or Hotel/Airbnb Partner signs in with their registered email address and access code. Wherever these Terms refer to a "password," that reference includes your access code or PIN.
• You are solely responsible for keeping your access code or PIN confidential. Treat it exactly as you would a bank card PIN or email password: do not share it with anyone, including another Family member, Babysitter, or business partner who has not been separately registered on the platform, and do not post it, email it insecurely, or store it anywhere an unauthorised person could reasonably access it.
• Write your access code or PIN down, or save it in a secure place (such as a password manager), as soon as you receive it. It is shown once on-screen at registration and included in your confirmation email; Elite Traders Lounge does not display it again afterwards except through the self-service reset process below.
• If you lose your access code or PIN, or reasonably suspect it has been compromised, you may request a reset through the "Forgot your access code?" link on the relevant sign-in page. For security, a reset can only be requested once every 7 days per account, and the reset link is single-use and email-verified. If you need a reset more urgently than this allows, contact inquiries@etlbabysitters.co.za.
• Elite Traders Lounge is not liable for any loss, damage, unauthorised booking, unauthorised access, or disclosure of your personal information arising from your failure to keep your access code or PIN confidential, including where it was guessed, shared, written down insecurely, or otherwise obtained by a third party through your own negligence. This limitation is in addition to, and does not narrow, Section 15 (Limitation of Liability) below.
• You must notify Elite Traders Lounge immediately at inquiries@etlbabysitters.co.za if you believe your account has been accessed without your authorisation, so access can be suspended and a new code issued.

12. Platform Role & Conduct

• Elite Traders Lounge operates as a booking and verification platform connecting independent Babysitters with Families. Babysitters engage as independent contractors and are not employees of Elite Traders Lounge.
• Both parties must use the dual-party check-in tool to confirm arrival and departure at every booking; timestamps recorded there are treated as the primary evidence of hours worked in any dispute.
• The full Code of Conduct, Dispute Resolution process, and Termination & Suspension terms are set out on the Policies page and form part of these Terms.
• Important: R5,000 Continued-Engagement Fee. If a Family and a Babysitter who were matched through Elite Traders Lounge keep working together, or start again, outside the platform within 12 months of their first booking through the platform, the Family must pay Elite Traders Lounge a Continued-Engagement Fee of R5,000. This is on top of any commission already owed on bookings made through the platform. The full terms, including how a report is reviewed before the fee is invoiced, are in Policies Section 6.6.

13. No Guarantee of Placement or Match

• For Babysitters, Au Pairs, and Nannies: successful registration, identity verification, background screening, or advancement through any recruitment, application, or interview process conducted or facilitated by Elite Traders Lounge does not guarantee that any Family will select, engage, book, or place that individual. A placement or booking with a specific Family is made entirely at that Family's discretion, whether decided following a platform-facilitated interview or otherwise, and Elite Traders Lounge makes no representation as to whether, or how many times, a Family will make contact, request an interview, or confirm a booking or placement with a given Babysitter, Au Pair, or Nanny.
• For Families: registration and payment of any registration, verification, or placement fee does not guarantee that a suitable Babysitter, Au Pair, or Nanny will be available to book or place at the time of the Family's request. Availability is contingent on the number and location of verified, active candidates registered on the platform and covering the Family's local service area (see Section 6 above) at the relevant time, and on those candidates' own willingness and availability to accept a specific booking or placement. Elite Traders Lounge does not guarantee coverage in every town, suburb, or city, or that a suitable candidate will be available within any particular timeframe.
• Nothing in this Section changes the fee, refund, or guarantee terms set out elsewhere in these Terms or on the Rates & Policies page (including the Au Pair replacement guarantee, where applicable) — it clarifies only that no successful placement, match, or booking with any particular counterparty is promised or guaranteed by registration, payment of a fee, verification, or participation in an interview or recruitment process.

14. Right to Refuse or Cancel Service

If safety is at risk, we may act without warning. In all other cases, we will give reasonable notice. If we use this right, the person affected is not owed any compensation, other than money already earned for work actually done.

15. Limitation of Liability

• We check, but we cannot guarantee. Elite Traders Lounge checks identity, proof of address and references on a best-efforts basis. It does not guarantee how any Babysitter or Family will behave, how well they will do the work, or whether they will suit you. It is not liable for any loss, injury or damage that comes from a booking arranged through the platform.
• Your access code. Elite Traders Lounge is not liable if someone gets into your account, or for any loss that follows, where you did not keep your access code or PIN private (see Section 11).
• Medicine and duties. Elite Traders Lounge is not liable for any harm, loss or damage if a Babysitter gives a child medicine, or if either side breaks the rules on duties, pet disclosure or cleaning (see Section 12).
• Paystack. Paystack handles the payments. Elite Traders Lounge is not a party to, and is not liable for, how Paystack processes, holds or times payments. Any payment problem involving Paystack is dealt with under Paystack's own terms and support channels.
• Your rights under the law. Nothing in these Terms removes any liability that South African law does not allow to be removed.

16. Changes to These Terms

Elite Traders Lounge may update these Terms & Conditions, the Policies page, or Appendix C rate bands from time to time, including to reflect changes in the National Minimum Wage.
